1.2. ENEB is part of the NAMENCIS Group. Enrolling in a Program marketed under the ENEB brand creates a relationship exclusively with Escuela de Negocios Europea de Barcelona, S.L.U.; nothing in these Terms shall be construed as creating joint or several obligations for any other entity of the Group.
Article 2. Purpose and Applicable Regulations
2.1. These General Terms and Conditions of Contract (the "Terms") govern the distance and electronic contracting of the training programs (each, a "Program", together, the "Programs") offered by Escuela de Negocios Europea de Barcelona, S.L.U. through the website eneb.com, as well as the resulting mutual rights and obligations.
2.2. The following apply: Royal Legislative Decree 1/2007 of 16 November, approving the restated text of the General Law for the Protection of Consumers and Users (the "TRLGDCU"); Law 34/2002 of 11 July (the "LSSI-CE"); Law 7/1998 of 13 April on General Contracting Terms; Regulation (EU) 2016/679 (General Data Protection Regulation, "GDPR") and Organic Law 3/2018 of 5 December; and any other applicable Spanish and European Union legislation.
2.3. Where the Student qualifies as a consumer under article 3 of the TRLGDCU, the protective regime set out in that law shall apply and shall prevail over any provision of these Terms that is less favourable. Where the Student contracts in the course of a business or professional activity, the provisions referring expressly and exclusively to the consumer protection regime shall not apply, in particular the right of withdrawal under Article 17.
Explanatory note: types of Program
Throughout these Terms, a distinction is drawn between two types of Program that are subject to different rules in several respects: Programs leading to ENEB's own qualification (in some cases together with an ECTS credit certification from Universidad Isabel I) and accredited Programs offered in partnership with Unimarconi, which are specifically governed by Article 19. The table below summarizes the main differences for guidance purposes only; in the event of any discrepancy, the relevant article shall prevail.
| Aspect | Own Title (ENEB / UI1) | Accredited Programs (Unimarconi) |
|---|---|---|
| Start of the academic period | Chosen by the Student, within 15 calendar days of enrollment (Art. 8.1) | Monthly intakes, always starting on the 15th of each month (Art. 19.7) |
| Extensions | Available, subject to an administrative fee (Art. 10.6) | Never available (Art. 19.2) |
| Assessment system | Continuous assessment per module, or optional multiple-choice exam (Art. 12) | Exam per subject plus a Master's Thesis (Art. 19.8) |
| Credit recognition and transfer | Available, under the terms of Art. 12 | Not applicable (Art. 12) |
| Degree issuance format | Digital copy included in the price; physical copy optional and subject to a fee (Art. 14.5) | Physical copy only (Art. 19.10) |
| Right of withdrawal | Applicable under Art. 17 | Applicable under Art. 17, except where enrollment is made by a company (Art. 18.5) |
Article 3. Pre-Contractual Information
3.1. The pre-contractual information provided forms an integral part of the contract and may not be unilaterally amended, save by express agreement of the parties.
3.2. These Terms are permanently available in a printable and downloadable format prior to the start of the enrollment process.
Article 4. Capacity to Contract and Access Requirements
4.1. The Student represents that they are of legal age and have sufficient legal capacity to be bound by these Terms. Where the Student is a minor, enrollment must be formalized by their legal representative, who shall assume the resulting financial obligations.
4.2. The Student undertakes to provide truthful, accurate and up-to-date identification, contact and billing details, and to report any change to such details.
4.3. The Student must meet the technical, language and, where applicable, academic or professional experience requirements specified in the Program's information sheet, and it is the Student's responsibility to verify in advance that they meet such requirements.
4.4. ENEB may at any time request documentation evidencing the Student's identity and the academic qualifications or experience declared, allowing a period of not less than ten (10) calendar days.
4.5. The deliberate provision of false information or documentation, or unjustified refusal to provide the documentation requested, shall constitute a breach of contract and shall entitle ENEB, following reasoned notice and allowing the Student a hearing period of not less than ten (10) calendar days, to adopt, having regard to the severity of the breach and the principle of proportionality, one of the following measures: adjust the qualification to be issued to the training and requirements actually evidenced, where the Program so permits; suspend issuance of the qualification until the defect is remedied; or terminate the contract.
4.6. Where the contract is terminated under the preceding paragraph, any amounts retained shall be limited to the amount corresponding to services actually rendered and to duly evidenced and proportionate administrative costs, with the remainder refunded to the Student. Retention of the full amount paid shall not proceed where this would be disproportionate, in accordance with articles 85.6 and 87.6 of the TRLGDCU.
Article 5. Online Enrollment Process
5.1. The enrollment process comprises the following successive stages:
- Selection of the Program and, where applicable, of the mode of study and intake.
- Completion of the enrollment form with the Student's identification, contact and billing details.
- Review of the order summary, indicating the Program selected, total price including taxes, any additional charges, and the payment method chosen.
- Provision of these Terms and of the Privacy Policy, with the option to read, download and print them in advance.
- Express acceptance of the Terms by checkbox, in accordance with Article 6.
- Confirmation of the order by means of a button unambiguously labelled "Order with obligation to pay" or an equivalent expression, in accordance with article 98.2 of the TRLGDCU.
- Execution of payment or, where applicable, processing of the financing application.
5.2. ENEB shall retain an electronic record of the enrollment process, including the time of acceptance, the version of the Terms accepted and the technical details of the transaction, for evidentiary purposes and for as long as legally required.
Article 6. Acceptance by Checkbox
6.1. These Terms are accepted by actively ticking a checkbox that is not pre-ticked, displayed prominently immediately before the order confirmation button, next to the statement: "I have read and accept the General Terms and Conditions of Contract and the Privacy Policy."
6.2. Ticking that checkbox constitutes an unequivocal expression of intent to be bound by these Terms and evidences that the Student has had a genuine opportunity to review their full content prior to enrollment, in accordance with articles 5 and 7 of Law 7/1998 of 13 April.
6.3. Acceptance of the Privacy Policy and, where applicable, consent to receive commercial communications shall be obtained through separate and distinct checkboxes, and enrollment may not be made conditional on giving the latter consent.
6.4. The express request for early commencement of the service and the acknowledgement of the loss of the right of withdrawal, both referred to in Article 17, shall be obtained through a checkbox that is specific to and separate from the one referred to in clause 6.1.
Article 7. Formation of the Contract
7.1. The contract shall be deemed perfected at the time the order is confirmed and payment is executed by the Student, in accordance with Article 5, without prejudice to the express acceptance of the Terms that the Student will separately complete on the Virtual Campus in accordance with Article 6.
7.2. Acceptance of these Terms shall be formalized by the Student through express acceptance on the Virtual Campus (Moodle), with such acceptance recorded electronically in ENEB's systems. The record evidencing acceptance shall remain part of the Student's electronic file and shall be permanently available for the Student to view and download from the Virtual Campus itself.
7.3. The Student must again give express acceptance of these Terms through the Virtual Campus each time they enroll in or purchase a new Program.
Article 8. Commencement of the Service
8.1. Once enrollment has been completed and the Student has been provided with access credentials to the Virtual Campus, the Student shall have a period of fifteen (15) calendar days to select the start date of their Program, using the procedures made available for that purpose on the Virtual Campus. This clause applies exclusively to Programs leading to an Own Title, and not to accredited Programs, which are organized through scheduled intakes in accordance with Article 19 (Accredited Programs); the fifteen-day period provided for in this clause does not apply to the latter.
8.2. Where the Student does not select a start date within the period provided for in the preceding clause, the academic period shall be deemed, for all purposes, to commence on the date on which ENEB sent the Student their access credentials to the Virtual Campus.
8.3. The duration of the academic period shall be as stated in the Program's information sheet, available for consultation on ENEB's website (eneb.com).
8.4. The obligation assumed by ENEB is an obligation of means, not of result. ENEB undertakes to make available to the Student the content, materials, teaching resources and assessment systems that make up the Program, without guaranteeing that the Student will pass it.
Article 9. Price, Taxes and Payment Methods
9.1. The price of each Program shall be the price expressly stated during the enrollment process, prior to completion of enrollment, on the relevant enrollment page or in the applicable commercial offer for the selected Program, and shall also be reflected in the order summary before it is confirmed by the Student. All prices shall be expressed in euros and shall include any taxes that are legally applicable.
9.2. Educational services are, as a general rule, exempt from Value Added Tax under Article 20.One.9 of Law 37/1992 of 28 December. Ancillary services not covered by this exemption shall be invoiced with the applicable tax, as indicated in the order summary.
9.3. The Student may pay the price using the available payment methods, in a single payment or in instalments, where offered. ENEB shall not charge the Student, for the use of a given payment method, fees exceeding the cost borne by ENEB, in accordance with article 60 ter of the TRLGDCU.
9.4. Financing through a partner entity. Where the Student arranges payment through financing granted by a financing partner of ENEB, the effectiveness of the contract shall be subject to the condition precedent of final approval of the financing. If financing is refused, the contract shall be automatically terminated, with no financial obligation on the Student, and any amounts paid in advance shall be refunded in full within a maximum of fourteen (14) calendar days.
9.5. Independent external financing. Where the Student obtains financing from an entity outside ENEB's financing partnerships, refusal of that financing shall not constitute grounds for termination of the contract, without prejudice to the Student's rights under Law 16/2011 of 24 June on Consumer Credit Agreements.
9.6. Non-payment. Non-payment of a due instalment shall accrue interest for late payment at the legally applicable rate, following a payment demand. If twenty (20) calendar days elapse from the payment demand without payment being made, ENEB may suspend access to the Virtual Campus, giving at least five (5) calendar days' prior notice; access shall be reinstated immediately once the situation has been regularized. Non-payment of two (2) or more instalments, or a delay of more than sixty (60) calendar days, shall entitle ENEB to terminate the contract, without prejudice to its right to claim amounts accrued for services actually rendered.
9.7. Being up to date with payment is a requirement for the issuance of any qualification.
9.8. Services not included in the price. The enrollment price does not include services or procedures of an extraordinary nature requested by the Student after enrollment. By way of guidance and without limitation, the following are subject to the applicable administrative fee: issuance of certificates, diplomas or any other document in physical format, legalization by Hague Apostille, international shipping and re-shipping, second markings and extraordinary sittings, credit recognition assessments, extensions of the academic period, reissuance of qualifications due to an error not attributable to ENEB, IT equipment, and, generally, any extraordinary documentation or procedure beyond the documentation ordinarily issued by ENEB.
9.9. For these purposes, enrollment certificates and invoices shall be considered ordinary documentation included in the service at no additional cost, without prejudice to repeated requests, special certifications or documents of an extraordinary content or format being subject to the applicable administrative fee.
9.10. Administrative fees applicable to ancillary or supplementary services other than enrollment may be updated at any time. The applicable amount shall be that in force on the date the Student requests the relevant service and shall be communicated to the Student before enrollment or payment. It is the Student's responsibility to check the administrative fees in force when requesting the relevant service. Fees reflect the management, processing and issuance costs actually incurred and are not punitive in nature.
Article 10. Access to the Virtual Campus
10.1. Once enrollment has been completed, ENEB shall provide the Student with personal access credentials to the Virtual Campus, the environment through which the service is provided and which acts as a repository of materials, a communication channel and a platform for submitting and assessing activities.
10.2. Access credentials are personal, confidential and non-transferable. The Student is responsible for keeping them secure and undertakes to report, without undue delay, any unauthorized use or loss of confidentiality.
10.3. It shall be presumed, unless proven otherwise, that access to and activity carried out using the Student's credentials was carried out by the Student. This presumption shall not apply where the Student had previously reported unauthorized use, nor where the misuse is attributable to a security failure in the School's systems.
10.4. ENEB shall use reasonable technical measures to ensure the availability and proper functioning of the Virtual Campus, without this constituting a guarantee of uninterrupted availability. Scheduled maintenance interruptions shall be notified in advance whenever possible.
10.5. Where a service interruption not attributable to the Student continues for more than seven (7) calendar days, the Student shall be entitled to an extension of the academic period for an equivalent period, at no cost.
10.6. Extensions. On expiry of the academic period, a free one (1) month extension is automatically granted, which does not apply to Higher Education Courses or PDDs (Executive Courses). Once that extension has been used, a further extension of the academic period may only be requested for Programs leading to an Own Title. An extension is subject to payment of an administrative fee, subject to update, which the Student must pay by contacting extensions@eneb.com. Extensions shall never be granted for accredited Programs offered in partnership with Unimarconi, as that university does not permit them. An extension may only be requested in respect of a Program that is active, or whose academic period ended no more than twenty (20) calendar days earlier. Payment of the extension fee applies exclusively to a single Program and shall not, under any circumstances, extend to all of a Student's active Programs.
10.7. Where a Program is not active, as referred to in Article 10.6, the Student must, where applicable, pay for a new enrollment in order to continue their studies. To do so, the Student must contact reactivations@eneb.com to check the applicable administrative fee. ENEB reserves the right to change enrollment fees and prices during the time that elapses between the Student's original enrollment and any request for re-enrollment. Reactivation shall not be permitted, under any circumstances, in respect of a Program that is no longer part of ENEB's current course offering. In such a case, the Student shall be offered enrollment in the Program most similar to the discontinued Program, having regard to the curriculum.
10.8. Where a Student pays for re-enrollment, the same Program shall be reinstated on the Virtual Campus profile the Student already had access to prior to the Program's expiry. The Student shall not receive new access credentials, nor shall a new user account be created. If the Student does not remember their password or has any problem accessing their Virtual Campus profile, they may request a password reset from the login screen itself or by contacting academy@eneb.com.
Article 11. Student Rights and Obligations
11.1. The Student is entitled to: receive the training contracted for on the terms described in the pre-contractual information; access the Virtual Campus and its content during the academic period and any extensions; use the tutoring support service by email, with a response within a maximum of seven (7) business days (Spain business days); be assessed according to objective, published and previously notified criteria, and to be informed of their grades; request a review of grades in accordance with academic policy; obtain the qualification once the Program has been passed and all applicable requirements met; exercise their data protection rights; file complaints and access out-of-court dispute resolution mechanisms; and receive respectful, non-discriminatory treatment.
11.2. The Student undertakes to: pay the price on the agreed terms; provide truthful information and documentation; make diligent and lawful use of the Virtual Campus and its content, limited to personal learning purposes; not transfer or share their access credentials; respect the intellectual property rights in the content; produce assessed work and assignments personally and originally; observe the applicable code of conduct; and keep the email address designated for notifications operational.
11.3. Disciplinary rules. The following shall, among others, be considered very serious offences: academic fraud of any kind; harassment, intimidation, threats and the use of offensive or discriminatory language; misuse of the platform or actions compromising its security or operation; and the intentional damage of facilities or equipment.
11.4. The imposition of a sanction shall require an adversarial procedure in which the Student is informed of the facts alleged against them and given a period of not less than ten (10) calendar days to submit arguments and evidence. The decision shall be reasoned and subject to review by the School's Management. Sanctions, ranging from a warning to termination of the contract with permanent withdrawal, must be proportionate to the severity of the facts.
11.5. Where the contract is terminated for reasons attributable to the Student, any amounts retained shall be limited to services actually rendered and duly evidenced damages, with the remainder refunded.
Article 12. Course Content and Assessment
12.1. The Program's content comprises the teaching materials, syllabi, audiovisual resources, case studies and activities made available to the Student through the Virtual Campus.
12.2. Content is dynamic in nature and may be updated during the academic period to keep it technically current. Such updates shall not alter the essential elements of the Program or reduce the services contracted for.
12.3. ENEB schedules live and recorded masterclasses, published in the Virtual Campus calendar. These sessions are supplementary in nature and are intended to add value to the Program, without forming part of the core service contracted for. The specific date and time of classes are subject to the availability of the instructors and professionals delivering them, and the School assumes no commitment as to any particular date or time, although classes are typically held Monday to Friday, in the afternoon (Spanish Peninsular Time).
Assessment System
12.4. For Programs leading to ENEB's Own Title or to a Universidad Isabel I certification, assessment is carried out through continuous assessment, consisting of the submission of a final assignment for each module, which must receive a minimum grade of five (5) out of ten (10). To pass the Program, the Student must have submitted one hundred percent (100%) of the assessable final assignments.
12.5. Multiple-choice exam option. As an additional service subject to a fee, the Student may opt for an assessment system based on a multiple-choice exam. This option is exclusive and replaces any grades previously obtained through continuous assessment in the subjects concerned, becoming the final grade for those subjects. ENEB assumes that, having read and accepted this document, the Student is aware of this consequence before paying the fee and choosing this option.
12.6. On payment of the administrative fee for the multiple-choice exam, the Student will receive an email to select the Program they wish to be examined on, with the option of sitting the exam for one Program only. Using the form provided, the Student must select the sitting in which they wish to take the exam. Each sitting always covers a specific 4-month period, and the exam will only be available on the Virtual Campus during that period; the exam may not be taken outside that period under any circumstances. If the Student allows the sitting to lapse, they must pay the administrative fee again to enroll in a further sitting.
12.7. A Student enrolled in a Double Master's may not take the assessments for each degree separately. The Student has two (2) attempts per exam; the second attempt may only be taken if the first was not passed.
12.8. Under no circumstances may the multiple-choice exam be taken for an expired Program. Where the Student has paid the fee for the multiple-choice exam but their Program has expired, they may choose either to pay for re-enrollment in the Program or to request a refund of the exam fee within fifteen (15) days.
12.9. Accredited Programs offered in partnership with the Università degli Studi Guglielmo Marconi (Unimarconi) are governed by the specific assessment system set out in Article 19.
12.10. Plagiarism or improper similarity detected in any test or assignment shall result in the consequences set out under "Academic Integrity" in this Article.
12.11. Additional sittings. A request for an extraordinary sitting or an additional attempt shall be subject to payment of the applicable fee, the amount of which reflects the management and marking costs incurred.
12.12. Exam supervision. ENEB may use identity supervision and verification systems for tests taken online. Their scope, the data processed and the retention period shall be notified to the Student in advance in accordance with data protection legislation, and shall be limited to what is strictly necessary to ensure the authorship and integrity of the test.
12.13. Certificate of non-completion. A Student who reaches the end of the academic period without passing the Program may request a certificate evidencing the subjects taken and the grades obtained, subject to payment of the applicable administrative fee.
Academic Integrity
12.14. Assignments and tests must be produced personally and originally. Uncredited use of third-party sources, copying, identity impersonation and the falsification of assignments or exams constitute academic fraud.
12.15. Detection of plagiarism or improper similarity shall result in a fail grade for the activity concerned and an obligation to redo it, with the new marking subject to payment of the applicable second-marking fee, the amount of which may vary and can be checked by contacting academy@eneb.com. The grade shall be communicated with reasons, indicating the evidence considered, and the Student shall have a period of not less than ten (10) calendar days to submit arguments before it becomes final.
12.16. Repeated or particularly serious academic fraud may result in application of the disciplinary rules under Article 11.
Credit Recognition and Transfer
This section applies exclusively to Programs leading to ENEB's Own Title or to a Universidad Isabel I certification, and under no circumstances to accredited Programs offered in partnership with the Università degli Studi Guglielmo Marconi.
12.17. External credit recognition. The Student may request recognition of subjects completed at other institutions, subject to the following limits: up to five (5) subjects in Master's Programs; up to seven (7) subjects in Double Master's and Global MBA Programs; and up to two (2) subjects in PDDs. Each request shall be subject to a study fee of forty-nine euros (€49) per subject recognized.
12.18. Internal credit transfer. A Student who has previously completed other ENEB Programs may request a credit transfer, provided that no more than forty percent (40%) of the total ECTS credits of the new Program, and no more than five (5) course blocks, are recognized in this way.
12.19. Recognized subjects shall appear on the academic record indicating that status, without a numerical grade. The study fee is non-refundable regardless of the outcome of the request, a fact of which the Student is expressly informed prior to submitting the request.
Article 13. Professional Internships
13.1. ENEB provides an intermediary service for the formalization of educational cooperation agreements with companies based in Spain.
13.2. Minimum requirements for host companies. ENEB shall not enter into an educational cooperation agreement, nor any related annex, with a company that does not undertake, prior to signature, to: (i) register the Student with the General Social Security Scheme for the entire duration of the internship, regardless of whether it is paid, in accordance with the fifty-second additional provision of Royal Decree-Law 2/2023 of 16 March; and (ii) pay the Student financial compensation for the internship, which may under no circumstances be lower than the Student's travel expenses. Any subsequent breach of these undertakings by the company shall entitle ENEB to terminate the relevant agreement.
13.3. Professional internships are strictly voluntary, do not form part of the assessed curriculum, and are not a requirement for obtaining the qualification.
13.4. Requirement that the Program remain active. An internship may only take place while the enrolled Program is active and within its academic period, including any extensions granted, both at the time of the request and throughout the actual duration of the internship. Accordingly, internship agreements shall not be processed or maintained where the Program has ended, has been suspended, or has been withdrawn for any reason.
13.5. Where the academic period ends while an internship already in progress has not been completed, the parties may agree to extend it to allow for its completion.
13.6. Identifying the host company and negotiating the specific terms of the internship are matters for the Student and the host entity. The School's involvement is limited to the administrative management of the agreement, at no additional cost and without any obligation as to the outcome in terms of securing a placement.
13.7. The School shall not be a party to the relationship between the Student and the host company and shall not be liable for the conditions under which the internship is carried out, without prejudice to the obligations it bears as the sponsoring entity of the agreement.
Article 14. Issuance of Diplomas, Certificates and Degrees
14.1. Nature of the qualifications. Qualifications issued by ENEB are a non-official university title, known in Spain as a "máster propio" (hereinafter, an "Own Title"), that evidence completion of the curriculum of the Program enrolled in, and do not constitute official Spanish master's degrees. Programs leading to an Own Title additionally give access to an ECTS credit certification issued by Universidad Isabel I (UI1), in accordance with clause 14.7. In the case of the Accredited Programs referred to in Article 19, the qualification is the one issued by the partner university identified in that Article (as at the date of these Terms, Unimarconi), which is accredited in nature and distinct from the Own Titles referred to above. Each such qualification is governed by the internal rules of the issuing institution concerned, with ENEB acting as the entity responsible for managing the process.
14.2. Minimum issuance period. No diploma, certificate of completion or other training credential of any kind shall be issued until fifteen (15) calendar days have elapsed from the date of enrollment in the Program. This period reflects the need to complete the administrative processing of the initial stage of enrollment, including verification of payment and confirmation that the right of withdrawal has not been exercised.
14.3. The period referred to in the preceding clause is not a delivery deadline for the qualification, but rather the earliest date on which its processing may begin, and applies without prejudice to the School's own issuance timelines and, where applicable, those of partner universities.
14.4. In addition to the elapse of that period, issuance requires that the Program has been passed, that all financial obligations have been met, and that the data and documentation necessary for issuance have been provided.
14.5. ENEB Own Title
Issued in digital format within a maximum of seven (7) business days from completion of the Program, provided the Student has completed the process of confirming their personal details on the Virtual Campus. The details provided by the Student are the details that will appear on the documents.
The digital copy of the ENEB Own Title diploma is included in the enrollment price, bearing the identifying mark "DIGITAL". Obtaining it requires submission of all assessable final assignments and a minimum grade of five (5) out of ten (10) in each of them.
- Physical format. Optional service subject to a fee. Covers diplomas issued by ENEB and university certificates (clause 14.7), printed in A3 size, together with the academic record printed in A4 format.
- Physical format with Hague Apostille. Optional service subject to a fee. The Student will receive the number of copies paid for; each copy comprises the academic record, the ENEB diploma and the university certificate corresponding to a Program, accompanied by a single Hague Apostille. Diplomas and university certificates shall also be delivered printed in A3 size.
- Cum Laude Certificate. Purchase of the full pack, in physical format or physical format with apostille, entitles the Student to the additional issuance of a Cum Laude certificate for any Program in which the Student obtained a grade of nine point five (9.5) or higher out of ten (10).
14.6. Shipping Costs and Fee Updates for Physical Diplomas
Shipping. Shipments outside Spain shall be subject to the international shipping fees in force. Changing the shipping destination from national to international, once fees have been paid, may involve an additional cost of one hundred euros (€100). Re-shipment due to an incorrect or incomplete address provided by the Student shall cost fifty euros (€50) for domestic shipments and one hundred euros (€100) for international shipments. Re-shipment costs attributable to the School or to the logistics operator shall be borne by the School.
Issuance, apostille and shipping fees may be updated. The applicable amount shall be the one in force at the time of the request and shall be communicated to the Student before payment. Updated information is available at diplomas@eneb.com.
14.7. Universidad Isabel I Certification and ECTS Credits
Nature. The ECTS credit certification is a service managed by ENEB and issued and regulated by Universidad Isabel I (UI1), in accordance with that university's internal rules. ENEB acts solely as the entity managing the process, with the decision on issuance resting exclusively with Universidad Isabel I. This certificate shall under no circumstances be issued to Students enrolled in accredited Programs offered in partnership with Unimarconi.
Issuance fee. The university certification carries an issuance fee of one hundred and ninety-five euros (€195), payable before processing begins. Students enrolled before November 2024 are exempt from this fee and shall retain the financial terms in force at the time of their enrollment.
ECTS credits allocated per Program:
| Program | ECTS Credits |
|---|---|
| Global MBA | 90 ECTS |
| Double Master's | 72 ECTS |
| Master's | 60 ECTS |
| PDD (Executive Course) | 12 ECTS |
| Higher Education Course | 2 ECTS |
Annual recognition limit. The maximum recognition is ninety (90) ECTS credits per academic year. Credits exceeding that limit shall be issued in the following academic year, and this shall not constitute any breach by ENEB nor give rise to any right to compensation or a refund.
ENEB shall inform the Student, prior to enrollment, where the combination of Programs enrolled in may result in this limit applying.
14.8. Priority Pass Option for Physical Diploma Issuance
a) Nature. The Priority Pass is an alternative arrangement to the standard issuance of physical diplomas, and not an additional service or a supplement to it. A Student who purchases it shall be subject to the terms of this clause, which replace those of the standard arrangement as regards timing, review and shipping.
b) Content. The Priority Pass includes: priority issuance of physical diplomas, with an estimated period of sixty (60) to ninety (90) days once all requirements to begin processing have been met; a personalized review of the Student's details and Programs prior to printing; access to video consultations with the Diplomas Department; and a flat shipping fee, regardless of destination country.
c) Timing. The sixty (60) to ninety (90) day period is an estimate and begins once all processing requirements have been met, without prejudice to the minimum period set out in clause 14.2 and to timeframes that depend on third parties, in particular partner universities, in accordance with clause 14.7.
d) Shipping. The flat shipping fee applicable to this option replaces the international shipping and re-shipping fees generally provided for in this Article. Its amount is as stated on the product page at the time of purchase.
e) Price. The price of the Priority Pass option is as stated on the product page and in the order summary at the time of purchase.
f) Withdrawal. As regards the right of withdrawal, purchase of the Priority Pass option is governed by Article 17.
14.9. Validity and Recognition of Qualifications
The validity of Own Titles in the private sector, and any weight they may be given in selection processes, public competitions or administrative procedures, depend on the rules governing each such procedure and on the law of the country in which they are to be relied upon.
It is the Student's responsibility to find out, prior to enrollment, whether the qualification is suitable for the specific purpose they intend to use it for, in particular as regards public examinations, professional association membership, access to doctoral studies, or procedures in third countries.
ENEB does not guarantee the official recognition, validation or accreditation of its qualifications by national or foreign institutions or bodies, and assumes no liability for the outcome of any such procedures, without prejudice to its obligation to provide truthful and non-misleading information on the nature of the qualification and to stand behind the accuracy of the information provided.
Article 15. Intellectual and Industrial Property
15.1. ENEB, or any third parties that have assigned the corresponding rights to it, hold all intellectual and industrial property rights in the Program's content, including manuals, syllabi, videos, recordings, supplementary materials, Virtual Campus software, trademarks, trade names and logos.
15.2. Enrollment in the Program grants the Student a personal, limited, non-exclusive, non-transferable licence, with no right to sublicense, valid during the academic period and any extensions, and limited to individual learning purposes.
15.3. The reproduction, distribution, public communication, adaptation, bulk downloading, transfer to third parties, and commercial exploitation, in whole or in part, of the content, is prohibited without prior written authorization. This does not apply to acts permitted under the legally established limits on copyright.
15.4. A breach of this Article shall entitle ENEB to suspend access to the Virtual Campus and, depending on the severity of the breach and the harm caused, to terminate the contract, following the adversarial procedure provided for in article 11.4, without prejudice to the exercise of any civil or criminal action that may be available. Qualifications already earned may only be withheld in the event of non-payment, in accordance with article 9.7.
15.5. Student work. Original assignments, projects and theses produced by the Student remain the Student's exclusive property. By submitting such work, the Student grants the School a free, non-exclusive, worldwide licence to reproduce, communicate and distribute it for academic, research or teaching illustration purposes only, always either anonymized or with express attribution of authorship. This licence shall last for five (5) years from submission, may be extended by express agreement, and may be revoked by the Student at any time by notice to the School, which shall cease such use within a maximum of thirty (30) calendar days.
15.6. Recording of sessions and image rights. Masterclasses and live classes may be recorded by ENEB solely for academic purposes and to make them available to students through the Virtual Campus. The Student's image and voice shall only be captured where the Student voluntarily activates their camera or microphone. A Student who does not wish to be recorded may take part using the available text-based channels, without any detriment to their academic rights.
15.7. Recordings shall be hosted on third-party platforms in an unlisted or equivalent mode, so that they are only accessible via the link provided within the course environment. The Student undertakes not to download, disseminate or distribute such recordings outside the academic setting.
15.8. Consent to the capture and dissemination of the Student's image and voice may be revoked at any time by notice to the School, which shall delete or edit the recording within a maximum of thirty (30) calendar days where technically possible, without prejudice to the lawfulness of the processing carried out before revocation.
Article 16. Limitation of Liability
16.1. ENEB shall be liable for any damage or loss caused to the Student as a result of a breach of the obligations assumed under this contract, in accordance with the general rules on contractual liability.
16.2. Except in cases of wilful misconduct, gross negligence, personal injury, or liability that may not be limited by law, liability for financial loss shall be limited to the total amount actually paid by the Student for the price of the Program.
16.3. ENEB shall not be liable for loss or damage arising from causes beyond the School's reasonable control, including failures of communications networks, of the Student's own equipment, or of third-party technology platforms, provided that reasonably required technical measures had been taken.
16.4. No guarantee is given as to the achievement of any specific professional, financial or employment outcome resulting from the training received.
16.5. ENEB assumes no liability in relation to obtaining visas or residence or stay permits, the granting of which is a matter exclusively for the competent authorities. In any in-person activities that may be organized, ENEB shall not be liable for the loss, theft or damage of personal belongings brought onto the premises by the Student.
16.6. Nothing in this Article excludes or limits the School's liability in cases where mandatory consumer protection legislation prevents such exclusion or limitation.
Article 17. Right of Withdrawal
17.1. A Student who qualifies as a consumer has a period of fifteen (15) calendar days from the date the contract was entered into to withdraw from it without giving reasons and without penalty. This period voluntarily improves on the statutory fourteen (14) calendar day period set out in article 102 of the TRLGDCU.
17.2. To exercise the right of withdrawal, the Student must notify their decision to the School by means of an unequivocal statement, sent to the contact email address or through any other means that allows the notice to be recorded. The Student may use the form set out in the Annex for this purpose, although its use is not mandatory. To meet the deadline, it is sufficient for the notice to be sent before it expires.
17.3. Where the right of withdrawal is validly exercised, the School shall refund all payments received from the Student, with no deductions, within a maximum of fourteen (14) calendar days from receipt of the notice, using the same payment method used for the original transaction unless the Student expressly indicates otherwise. The refund shall not entail any cost to the Student, in accordance with article 107.1 of the TRLGDCU.
17.4. Loss of the right of withdrawal. In accordance with article 103.m) of the TRLGDCU, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium where performance has begun with the consumer's prior express consent and with the consumer's acknowledgement that, as a result, they lose their right of withdrawal. Accordingly, the Student shall lose their right of withdrawal where the following three circumstances are all met:
- The Student has expressly requested early commencement of the service before expiry of the withdrawal period, by ticking the specific checkbox provided for in article 6.4.
- The Student has expressly acknowledged, by means of that same checkbox, that access to the digital content will result in the loss of their right of withdrawal.
- The Student has actually accessed the Virtual Campus and the Program's digital content using their personal credentials.
17.5. Where any of the above requirements is not met, the Student shall retain their right of withdrawal in full for the period set out in clause 17.1. The School shall retain electronic evidence of compliance with these requirements for evidentiary purposes.
17.6. In the case of services other than the supply of digital content, where the Student has expressly requested early commencement of performance during the withdrawal period and subsequently exercises that right, the Student shall pay only the amount proportional to the part of the service actually performed up to the time of the notice, calculated on the total contract price, in accordance with article 108.3 of the TRLGDCU.
17.7. Exercise of the right of withdrawal shall never be conditional on the return of promotional gifts given to the Student, without prejudice to the School's right to request their return in the condition in which they are held.
Program Change, Voluntary Withdrawal and Cancellation
17.8. Within seven (7) calendar days of enrollment, the Student may request a change to another Program of the same level and equivalent price at no cost, provided they have not accessed assessable content of the original Program. Between the eighth and fifteenth day, a change may be requested subject to payment of an administrative fee of thirty-nine euros (€39), provided the Student has not submitted any assignments or taken any assessments. No changes shall be permitted after fifteen (15) calendar days, save with the express authorization of Academic Management. Where the destination Program has a different price, the difference shall be paid or refunded, as applicable.
17.9. Once the withdrawal period has elapsed, the Student may withdraw voluntarily by written notice. Voluntary withdrawal shall not give rise to a refund of amounts corresponding to services already rendered, nor shall it exempt the Student from paying amounts accrued and outstanding in that respect.
17.10. The Student may terminate the contract, with the right to a refund of the part of the price corresponding to services not yet rendered, where there is a duly evidenced material breach by the School.
17.11. Where duly evidenced, unforeseen force majeure circumstances prevent the Student from continuing the Program, the parties shall agree an equitable solution, which may consist of a temporary suspension of the academic period, deferral to a later intake, or a proportional refund of the part not yet rendered.
17.12. If the School cancels a Program before it begins, the Student shall be entitled, at their choice, to a full refund of the amounts paid or to be placed on another Program of equivalent characteristics. If force majeure makes it necessary to suspend a Program that has already begun, equitable solutions shall be offered, such as resumption at a later date, delivery in an alternative format, or a proportional refund of the part not yet rendered.
Article 18. Exclusions and Special Provisions
18.1. Promotional gift. Students who complete enrollment by paying the full price of the Program without applying any scholarship, discount or promotional price may receive the promotional gift determined by ENEB for each campaign, which may not be combined with any other promotion. The gift shall be shipped once the withdrawal period has elapsed, provided the Student has not exercised that right and is up to date with their payment obligations. The model and features of the gift may vary depending on stock availability. The legal warranty on the product shall be the one offered by the manufacturer, and the Student shall be sent the invoice required to make a claim under it. International shipping and re-shipping costs shall be governed by Article 14.
18.2. International students with a study residence permit. This clause and the following two clauses apply exclusively to Students who reside in Spain under a study residence permit; they do not apply to Students who take a Program remotely from another country without such a permit. An international Student is aware that their permit to reside in Spain for study purposes requires them to actually maintain their academic status and to actually take part in the training activities in which they are enrolled, and undertakes to take part in such activities in accordance with the internal rules of ENEB and of the partner university, and to justify, where applicable, any absences that may affect their normal progress in their studies.
18.3. The Student is informed that abandoning their studies, academic withdrawal, unjustified failure to meet the applicable requirements, or continued unjustified absence may, following the relevant administrative procedure and subject to the right to a hearing, result in the withdrawal or revocation of their study residence permit, in accordance with the applicable immigration legislation.
18.4. The Student authorizes ENEB to notify the competent immigration authorities of any circumstances involving the cessation, abandonment or loss of student status, for the purposes of complying with legal monitoring obligations. Before making any such notification, ENEB shall inform the Student and shall allow them a period of not less than five (5) calendar days to submit arguments or supporting documentation.
18.5. Programs contracted by companies. Where enrollment is arranged by a legal entity for the benefit of its employees, the contracting entity shall assume the financial obligations, and the beneficiary Student shall be subject to the academic and conduct obligations set out in these Terms. In such cases, the right of withdrawal under Article 17 shall not apply.
Article 19. Accredited Programs Offered in Partnership with Unimarconi
19.1. Accredited Programs. ENEB offers, under a partnership agreement entered into with the Università degli Studi Guglielmo Marconi (hereinafter, "Unimarconi"), certain Programs leading to an accredited university qualification recognized by the Ministero dell'Università e della Ricerca of the Italian Republic. As at the date of these Terms, those Programs, each with a duration of nine (9) months and a workload of sixty (60) ECTS credits, are the following:
- MBA – Master of Business Administration.
- Master in Big Data and Business Intelligence.
- Master in Sales Management and Marketing.
- Master in Human Resources Management and Talent Management.
19.2. No extensions. Extensions of the academic period shall under no circumstances be granted for accredited Programs offered in partnership with Unimarconi, in accordance with Article 10.6. A Student who does not complete their studies within the corresponding academic period must arrange a new enrollment in order to continue the Program.
19.3. Exclusive application. The provisions of this Article apply exclusively to accredited Programs offered in partnership with Unimarconi, without prejudice to the application of the remaining provisions of these Terms to any matter not specifically governed by this Article.
19.4. Access requirements. The Student must evidence that they hold a completed official university degree, by providing the degree certificate or, failing that, proof that their academic file has been closed, together with their academic transcript for that degree and a copy of their valid identity document. Where the underlying degree was completed at a university outside the European Union, the academic documentation must be legalized by Hague Apostille.
19.5. Deadline for submitting documentation. Documentation must be submitted at least ten (10) calendar days before the start of the intake. ENEB shall formally request the documentation from the Student before that deadline expires and shall allow a further remedy period of not less than ten (10) calendar days.
19.6. Consequences of non-compliance. If the remedy period elapses without the Student having submitted the required documentation, ENEB may cancel processing of the Unimarconi qualification. In that case, the Student may continue the Program for the purpose of obtaining ENEB's Own Title.
19.7. Intakes. Accredited Programs are organized through monthly intakes, always starting on the fifteenth (15th) day of each month. During enrollment, the Student shall receive a form on which they must select the monthly intake in which they wish to start the Program; the fifteen (15) calendar day period for selecting a start date under Article 8 does not apply to accredited Programs. Before the start of the selected intake, the Student undertakes to submit the documentation required under clause 19.4 (official university degree or proof of closure of academic file, academic transcript, valid identity document and, where applicable, Hague Apostille).
19.8. Assessment system. The Student must pass all subjects of the Program by means of an exam per subject, with a minimum grade of six (6) out of ten (10), and must produce and submit a Master's Thesis of at least twelve thousand (12,000) words, with a minimum grade of six (6) out of ten (10); there is no requirement for these two requirements to be completed in any particular order. The Student has one (1) attempt to submit the Master's Thesis; a further attempt shall require payment of an administrative fee of ninety-nine euros (€99). ENEB may use identity supervision and verification systems for tests taken online, on the terms set out in Article 12. A Student who reaches the end of the academic period without passing the Program may request a certificate evidencing the subjects taken and the grades obtained, subject to payment of the applicable administrative fee.
19.9. Graduation ceremony. Once nine (9) months have elapsed from the start of the Program, and the assessment requirements set out in clause 19.8 have been met, the Student must take part in a graduation ceremony, held in the presence of representatives of ENEB and of Unimarconi, usually by video call, at which the Student shall be formally declared to have completed the Program. Although this is an administrative and formal procedure, it is mandatory for the Program to be formally completed and for the resulting qualification to be processed.
19.10. Issuance format. Unimarconi issues its qualifications exclusively in physical format. ENEB shall act as an intermediary in receiving and forwarding the qualification to the Student. Issuance timeframes depend on the issuing university, and ENEB cannot be held responsible for delays attributable to it, although ENEB undertakes to inform the Student of the status of processing on request.
Article 20. Personal Data Protection
20.1. Personal data provided by the Student shall be processed by ENEB, as data controller, in accordance with Regulation (EU) 2016/679 and Organic Law 3/2018 of 5 December.
20.2. The purposes of processing include managing enrollment and the academic record, providing the training service, billing and payment collection, handling queries and complaints, complying with legal obligations, and, subject to separate and revocable consent, sending commercial communications.
20.3. Data may be disclosed to technology providers acting as data processors, to financing partners where the Student applies for financing, to Universidad Isabel I and, where applicable, to the Università degli Studi Guglielmo Marconi, solely for the purposes of registration, record-keeping and issuance of the relevant certifications and qualifications, and to public authorities where legally required.
20.4. The Student may exercise their rights of access, rectification, erasure, objection, restriction of processing and portability, and may withdraw any consent given, by contacting the Data Protection Officer at datos@namenciseducation.com, and may lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos).
20.5. Full information on data processing is set out in the Privacy Policy published at eneb.com, which is made available to the Student prior to enrollment.
Article 21. Customer Service and Complaints
21.1. The Student may direct queries, issues and complaints to academy@eneb.com, which shall respond within a maximum of seven (7) business days (Spain business days) of receiving the email.
21.2. The School shall acknowledge receipt of complaints and resolve them within a maximum of one (1) month of submission, notifying the Student of the reasoned response on a durable medium.
21.3. The School has hojas oficiales de reclamaciones (official Spanish consumer complaint forms) available to the Student in accordance with the applicable regional consumer protection legislation.
21.4. The Student may refer the matter to alternative consumer dispute resolution bodies and entities, as well as to the EU Online Dispute Resolution platform provided for in Regulation (EU) 524/2013, available at https://ec.europa.eu/consumers/odr.
Article 22. Amendment of these Terms, Partial Invalidity and Notices
22.1. The School may amend these Terms to adapt them to regulatory changes, changes in the service provided, or justified technical or organizational reasons. Amendments shall be published on the website indicating their effective date and shall apply only to enrollments completed thereafter.
22.2. Where an amendment affects contracts already in progress and involves a change to essential terms, the Student shall be notified at least thirty (30) calendar days in advance and shall be granted the right to terminate the contract without penalty and with a refund of the part of the price corresponding to services not yet rendered.
22.3. A declaration by a competent authority that any of these clauses is void, unfair or ineffective shall not affect the validity of the remaining clauses, which shall remain fully effective. The affected clause shall be construed in accordance with article 83 of the TRLGDCU and article 10 of Law 7/1998.
22.4. The Student may not assign their position under the contract without the School's prior written consent. The School may assign the contract to another entity of the NAMENCIS Group, having first notified the Student at least thirty (30) calendar days in advance, without any reduction of the Student's rights and granting the Student the right to terminate the contract if the assignment would cause them harm.
22.5. Failure by either party to exercise a right or power recognized under the contract shall not constitute a waiver of that right, nor prevent its exercise at a later time.
22.6. Communications between the parties shall be made in writing, preferably by electronic means, to the addresses designated for that purpose. The Student undertakes to keep their email address operational and to report any change to it.
Article 23. Governing Law and Jurisdiction
23.1. These Terms are governed by Spanish law.
23.2. Prior to bringing legal proceedings, the parties shall seek to resolve any dispute amicably through the student services department.
23.3. Where the Student qualifies as a consumer, the competent courts shall be those corresponding to the Student's domicile, in accordance with the mandatory rules on territorial jurisdiction, and no agreement submitting to a different jurisdiction to the Student's detriment shall be valid, in accordance with article 90.2 of the TRLGDCU.
23.4. Where the Student contracts in the course of a business or professional activity, the parties submit to the courts of the city of Madrid, expressly waiving any other jurisdiction.
23.5. The foregoing is without prejudice to the rules on jurisdiction and applicable law set out in Regulation (EU) 1215/2012 and Regulation (EC) 593/2008 for Students resident in other European Union Member States.
